This legislation nullifies a recent decision by the Copyright Royalty Board that threatens the viability of music webcasting. Unless addressed by Congress, the CRB's March 2, 2007 decision could dramatically affect FolkAlley.com's ability to stream music 24 hours a day to thousands of listeners across the U.S. Folk Alley is an online hub created to highlight and preserve folk and other roots- and tradition-based musical forms. A non-profit, member-supported Internet music service, Folk Alley brings together listeners and artists specializing in an underrepresented musical genre. The CRB's action ignores Folk Alley's public service mission and obligations to bring programmatic diversity to the web and be a reliable source of cultural programming. The ruling could saddle Folk Alley with egregious and inappropriate financial requirements created with a commercial broadcast model in mind.
